Bill Myers, a railroad accident lawyer, obtained a $750,000 settlement for a trackman / machine operator who was injured while using a track jack to lift a track stabilizer “bogie”, which had failed to lift hydraulically.
The base of the track jack fractured suddenly, causing the railroad trackman / machine operator to fall to the ground and injure his back. Attorney Bill Myers took numerous depositions which established that employees had made numerous many complaints about the bogies failing to lift normally. Attorney Myers was able to demonstrate that the railroad employee responsible for maintenance of the track stabilizer had never been trained how to maintain or repair it. This lead to a $750,000 settlement with Amtrak.
